Memorandum of Understanding (MOU) with unions

An MOU was signed on 31 July 2019 by the Secretaries of Transport and Unions NSW (on behalf of all relevant unions). This MOU is effective for the life of the 2019 RMS awards, that is, when they are replaced by another Award(s).

The MOU demonstrates the commitment made by the Transport Secretary to the continued operation of the RMS Awards and coverage of these Awards to those staff who are in the ‘RMS Group of Staff’ that were performing work previously undertaken by RMS.

The MOU also sets out agreed processes for possible changes, including the consultation being conducted under agreed principles.

The MOU guarantees that:

  • The RMS Group of Staff created under the Transport Administration Act is retained
  • Former RMS employees within the RMS Group of Staff are retained in that group
  • Former roles or vacant existing roles assigned to RMS are retained
  • Where there is a restructure or realignment where it is proposed to change:
    • existing RMS Group roles or
    • creates new roles where the majority of the role’s functions are the same as existing RMS roles:
      • the employees assigned to those roles will come within the RMS Group of Staff and be covered under the applicable RMS Award, unless following consultation it is agreed that it would be optimal for the role to be covered by the Transport for NSW Award Salaries and Conditions Award 2019
      • for all other RMS roles any transfer will require consultation and a no net detriment principle will be adopted
